1. Overview

Welcome to VoltNomad. In these Terms of Service, “VoltNomad”, “we”, “us” and “our” refer to JCH Services Limited, trading as VoltNomad. We operate the VoltNomad website and online store, including related information, content, products, features, tools and services, together referred to as the “Services”. Our store is powered by Shopify, which helps us provide the Services to you.

These Terms apply when you visit, browse, interact with, create an account with, subscribe to communications from, or purchase from our Services. By using the Services, placing an order, creating an account, or clicking to accept these Terms, you agree to these Terms and our Privacy Policy at https://voltnomad.co/policies/privacy-policy.

If you do not agree, please do not use the Services or place an order. We currently sell and ship only within the United States and do not offer sales, delivery or returns outside the United States.

2. Eligibility and Account Information

You must be at least 18 years old, or the age of majority in your state if higher, to use the Services or place an order. If you use the Services on behalf of another person or organization, you confirm that you have authority to do so.

Please provide accurate, current and complete information when creating an account, placing an order or contacting us. You are responsible for your account credentials and for activity under your account. Please contact us promptly at support@voltnomad.co if you suspect unauthorized use of your account, payment method or order information.

3. U.S. Only Sales, Sanctions and Export Compliance

VoltNomad currently sells and ships only within the United States. Orders are fulfilled and shipped within the United States by fulfillment partners unless we state otherwise on the product page or at checkout.

You must not use the Services or place an order in a way that violates sanctions, embargoes, export controls or restricted-party rules that apply to you or to us. We may refuse, cancel, hold or refund an order where we reasonably believe fulfillment may breach applicable law or create regulatory risk.

Products purchased from VoltNomad are intended for personal, household or gift use only and not for commercial resale, onward export or distribution unless we agree in writing.

4. Our Products

VoltNomad sells apparel and lifestyle products inspired by van life, travel, adventure and the open road. Products are supplied through fulfillment partners and may vary slightly from product images, digital mockups or previews.

We make reasonable efforts to describe and display products accurately. However, ordinary variations in print placement, color, size, finish, fabric feel, garment batch, screen display and fulfillment method may occur. These ordinary variations are not defects.

Please review product descriptions, size guides, care instructions, color options, shipping details and order information carefully before placing an order. Any offer for a product or service is void where prohibited by law.

5. Orders and Payment

When you place an order, you are making an offer to purchase the products in that order. Your order is accepted when we process payment and send an order confirmation email.

We may refuse, cancel or limit an order for any lawful reason, including suspected fraud, unauthorized payment activity, pricing or product errors, unusual order activity, suspected resale activity, product unavailability or fulfillment issues.

Please check your order carefully before submitting it. Once an order has moved into processing, we may be unable to cancel or change it. You confirm that the payment information you provide is accurate, that you are authorized to use the payment method, and that you will pay all charges shown at checkout.

6. Prices, Taxes, Discounts and Promotions

Prices are listed in U.S. dollars unless stated otherwise. Prices, discounts, shipping charges, taxes and availability may change before an order is placed. The price charged will be the price shown at checkout when you submit your order, plus any applicable taxes, shipping and other charges shown at checkout.

Sales tax may be calculated and collected where required by applicable U.S. law. We may correct tax, pricing or promotional errors where permitted by law.

Discount codes and promotions are valid only for the period stated and may be redeemed only through our website or checkout, unless we state otherwise. Codes have no cash value, may not be combined with other offers unless stated, cannot be applied retrospectively, and may be withdrawn or refused if we reasonably suspect misuse, fraud or breach of these Terms.

7. Shipping, Delivery and Address Accuracy

Shipping options, rates and estimated timeframes will be shown on our website or at checkout. Delivery estimates are not guarantees and may be affected by carrier delays, weather, holidays, fulfillment delays, supply chain issues, incorrect addresses or events outside our reasonable control.

If shipment is materially delayed, we will handle the order in line with applicable U.S. mail, internet and telephone order rules, including notifying you and offering appropriate options where required.

You are responsible for providing a complete and accurate delivery address. If a package is delayed, returned, lost or delivered incorrectly because of an address error, we may be unable to offer a free replacement or refund. Risk of loss passes to you when the carrier confirms delivery to the shipping address you provided, except where applicable law requires otherwise.

8. Returns, Refunds and Replacements

Returns, refunds and replacements are governed by our Refund Policy at https://voltnomad.co/policies/refund-policy, which forms part of these Terms.

If an item arrives damaged, defective, incorrect or materially different from what you ordered, please contact support@voltnomad.co within the timeframe stated in our Refund Policy with your order number, a description of the issue and clear photos where helpful. Where a claim is approved, we may offer a replacement, refund, store credit or another appropriate remedy.

We generally do not accept returns, refunds or exchanges for change of mind, incorrect size or color selection, duplicate orders placed by mistake, ordinary product variations that are not defects, or damage caused by misuse, wear and tear, incorrect washing, alteration or failure to follow care instructions. Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

9. Product Care and Safety

Please follow the product details, size information and care instructions provided with or for the product. Damage caused by ordinary wear and tear, misuse, incorrect washing, improper drying, alteration, accidental damage or failure to follow care instructions is not considered a product defect.

We work with fulfillment partners and expect products to comply with applicable U.S. product, textile, labeling and safety requirements. Products should be used only for their ordinary intended purpose.

10. Intellectual Property

The Services, including website design, text, graphics, images, logos, product names, designs, slogans, photography and other materials, are owned by VoltNomad, JCH Services Limited, our licensors or relevant third parties and are protected by intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You must not copy, reproduce, distribute, modify, display, publish, scrape, sell, resell, exploit or create derivative works from any part of the Services without our prior written permission.

11. Intellectual Property Complaints

If you believe content on the Services infringes your copyright, trademark or other intellectual property rights, please contact support@voltnomad.support with your name and contact details, identification of the protected work or mark, identification of the material in question, a statement explaining why you believe the use is unauthorized, and any supporting information reasonably needed for us to review the complaint.

We may remove or disable access to content, products or materials where we believe it is appropriate or legally required.

12. Third-Party Services and Shopify

The Services may include third-party tools, links, integrations or services, including Shopify, payment processors, analytics providers, fulfillment partners and shipping carriers. We do not control third-party services and are not responsible for their content, policies, practices or availability.

VoltNomad is powered by Shopify, but purchases from our store are made directly with JCH Services Limited trading as VoltNomad. Shopify is not responsible for products, fulfillment, refunds, injury, damage, loss or customer service relating to your purchase from VoltNomad.

13. Privacy and Electronic Communications

Our collection and use of personal information is described in our Privacy Policy at https://voltnomad.co/policies/privacy-policy. Personal information may be processed by Shopify and other service providers as described in that policy.

By using the Services or placing an order, you agree to receive electronic communications from us, including order confirmations, shipping notices, customer service messages, legal notices and policy updates. Marketing messages will be sent only where permitted by law and subject to any unsubscribe or opt-out options we provide.

We comply with the CAN-SPAM Act for commercial email communications. Marketing emails will include a clear way to unsubscribe and we will process opt-out requests within 10 business days. If you consent to SMS marketing, your consent is governed by the Telephone Consumer Protection Act (TCPA). You may opt out of SMS marketing at any time using any reasonable method we provide or recognize, including replying STOP where available. Message and data rates may apply.

14. California Privacy Rights

If California privacy law applies to VoltNomad or to your interaction with us, California residents may have rights relating to personal information, including rights to know, access, correct, delete or opt out of certain uses of personal information. We do not sell personal information as that term is commonly understood.

15. Reviews, Feedback and User Content

If you submit reviews, photos, comments, feedback, suggestions or other content to us or through the Services, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable license to use that content for any lawful business purpose, including operating, improving and promoting the Services.

You confirm that you own or have the necessary rights to submit the content, that it is truthful where it states facts, and that it does not infringe third-party rights, violate law, contain malware, or include unlawful, abusive, defamatory, obscene or misleading material. We may monitor, edit, reject or remove user content where appropriate, but we are not required to do so.

16. Errors, Availability and Service Changes

The Services may occasionally contain errors, inaccuracies or omissions relating to product descriptions, images, pricing, promotions, shipping charges, transit times, availability or other information. We may correct errors, update information, cancel orders or change availability at any time where permitted by law.

We do not guarantee that the Services will always be available, uninterrupted, timely, secure or error-free. We may suspend, withdraw or restrict all or part of the Services for business or operational reasons.

17. Prohibited Uses

You may use the Services only for lawful purposes. You must not use the Services to violate law; infringe intellectual property or privacy rights; submit false or misleading information; transmit malware; scrape or harvest data; send spam; interfere with security features; impersonate others; harass, abuse, defame, intimidate or discriminate against others; attempt unauthorized access; or engage in conduct that could damage VoltNomad, Shopify, our partners, customers or the Services.

We may suspend, restrict or terminate access to the Services where we reasonably believe these Terms have been violated.

18. Accessibility

We want the Services to be accessible and easy to use. If you experience difficulty accessing any part of the Services, please contact support@voltnomad.support and we will make reasonable efforts to help or provide the information you need in another reasonable format.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis, except as expressly stated by us in these Terms, the Refund Policy or written product information.

To the fullest extent permitted by law, we disclaim implied warranties and conditions, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. Some jurisdictions do not allow certain exclusions, so some exclusions may not apply to you. Nothing in these Terms excludes, limits or modifies rights or remedies that cannot be excluded, limited or modified by law.

20. Limitation of Liability

To the fullest extent permitted by law, VoltNomad, JCH Services Limited, Shopify and our respective directors, officers, employees, contractors, partners, suppliers, fulfillment providers, agents and licensors will not be liable for indirect, incidental, consequential, special, exemplary or punitive damages, lost profits, lost revenue, loss of data, loss of goodwill, replacement costs or similar losses arising from or relating to the Services or products.

To the fullest extent permitted by law, our total liability for any claim relating to an order, product or use of the Services will not exceed the amount you paid to us for the product or order giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

21. Indemnification

You agree to indemnify and hold harmless VoltNomad, JCH Services Limited, Shopify and our respective affiliates, officers, directors, employees, contractors, licensors, service providers and agents from losses, liabilities, damages, claims and expenses, including reasonable legal fees, arising from your breach of these Terms, violation of law or third-party rights, misuse of the Services, or content you submit.

22. Events Outside Our Control

We will not be liable for delay or failure to perform caused by events outside our reasonable control, including carrier delays, fulfillment partner delays, supply shortages, labor disputes, severe weather, natural disasters, acts of government, war, terrorism, civil unrest, pandemics, utility failures, internet outages, platform outages or similar events.

23. Termination

We may suspend or terminate your access to the Services where we believe it is necessary or appropriate, including where you breach these Terms or create risk for us, our customers, Shopify or third parties. You may stop using the Services at any time. Termination does not affect outstanding orders, payments due, or rights and obligations that arose before termination.

Sections that by their nature should survive termination will continue to apply, including intellectual property, privacy, feedback, disclaimers, limitation of liability, indemnification, governing law and dispute resolution.

24. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them, the Services or any purchase from VoltNomad are governed by the laws of England and Wales, without regard to conflict-of-law rules.

Before starting formal proceedings, you agree to contact us at support@voltnomad.support so we can try to resolve the issue informally and fairly. The courts of England and Wales will have jurisdiction, except where applicable U.S. consumer protection law gives you mandatory rights or remedies in your state of residence that cannot lawfully be excluded or limited by these Terms.

Nothing in this section prevents either party from bringing an individual claim in small claims court where permitted, or from seeking urgent court relief to protect intellectual property, confidential information or other rights.

25. Changes to These Terms

We may update or replace these Terms from time to time by posting the updated version on our website. Where required by law, we will provide notice of material changes. Your continued use of the Services after changes become effective means you accept the updated Terms.

26. General Terms

If any provision of these Terms is found unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law or modified to the minimum extent necessary, and the remaining provisions will remain in effect.

Our failure or delay in enforcing any provision is not a waiver of our right to do so later. These Terms, together with policies incorporated by reference, form the entire agreement between you and us regarding the Services and supersede prior statements about the same subject. You may not assign your rights or obligations without our prior written consent. We may assign or transfer our rights and obligations where permitted by law. Section headings are for convenience only and do not affect interpretation. Any ambiguity will not be construed against the party who drafted these Terms.
